END-USER LICENSE AGREEMENT FOR
MASC - Mobile Automated
Sales Control
IMPORTANT-READ
CAREFULLY
Annual
License Fee
This Software
is licensed for use on an annual basis and will require the payment of annual
fee for each handheld and desktop installation. You will be billed each year in Advance
in November, your license will expire on 31st December and your account must be
paid before your license number can be released.
Following the installation
your first support and annual license fee will be billed and will be payable
within 30 days.
This MASC License Agreement (MASCLA)
is a
legal agreement between you (either an individual or a single entity) and
Handheld Computer Solutions
Ltd or its agents E-Management Systems Ltd and Jones Business Systems
for the
software product identified above, which includes computer software and
associated media and printed materials,
and may include "online" or electronic documentation ("SOFTWARE
PRODUCT" or "SOFTWARE"). By
installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be
bound by the terms of this MASCLA . If you do not agree to the
terms of this MASCLA , promptly return the unused
SOFTWARE PRODUCT to the place from which
you obtained it for a full
refund.
SOFTWARE PRODUCT
LICENSE
1. GRANT OF
LICENSE
This MASCLA grants you the following
rights:
Permission - You may use this
software in your business to
synchronise and load data to and from handheld computers. Every handheld
computer required an additional software licence.
Systems Software - You may
install and use MASC Desktop
software on as many computers as you wish within your office. You may only
install the handheld software on a single handheld device. Each device will
require an additional license.
You may not rent or lease
this SOFTWARE
PRODUCT.
Reverse Engineering - You may
not reverse engineer, decompile or
disassembly the SOFTWARE
PRODUCT. Other components included
in this install are the copyright of the respective
authors.

COPYRIGHT
All title and copyrights in
and to the SOFTWARE PRODUCT (including but
not limited to any images,
photographs, animations, video, audio, music,
text, and "applets,"
incorporated into the SOFTWARE PRODUCT), the
accompanying printed
materials, and any copies of the SOFTWARE PRODUCT,
are owned by the author of
MASC. The SOFTWARE PRODUCT is protected by
copyright laws and
international treaty provisions.
3.
MISCELLANEOUS
NO LIABILITY FOR CONSEQUENTIAL
DAMAGES
To the maximum extent
permitted by applicable law, in no event shall me be
liable for any special,
incidental, indirect, or consequential damages
whatsoever (including, without
limitation, damages for loss of business
profits, business
interruption, loss of business information, or any other
pecuniary loss) arising out of
the use of or inability to use the software
product, even if we has been
advised of the possibility of such damages.
MASC
Software Maintenance Contract
As part of your annual license fee you are covered
for email phone and pc connection support for MASC desktop software and handheld
software, you are also entitled to software upgrades and program enhancements
for the products originally purchased.
The support is limited to software errors and
operating assistance and does not cover product training. Should onsite
assistance be required this is payable at our normal daily
rate.
